Terms of Use

These Terms of Use ("Terms") govern your use of the Weatherball app and its companion widgets and Apple Watch app (together, "Weatherball"). By downloading or using Weatherball, you agree to these Terms.

Weatherball is provided by 44 Points ("we," "us," "our"). If you do not agree to these Terms, please do not use the app.

1. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use Weatherball on Apple devices that you own or control, as permitted by the App Store Terms of Service and the Apple Standard End User License Agreement (the "Standard EULA"). You may not copy, modify, reverse-engineer, redistribute, or create derivative works from the app except as allowed by law.

2. Weather information disclaimer

Do not rely on Weatherball for safety-critical decisions. Weather and forecast data is provided for general informational purposes only, is sourced from third parties (including Apple WeatherKit), and may be inaccurate, incomplete, or delayed. Always consult official sources — such as your national weather service and local emergency authorities — for severe weather, travel, marine, aviation, or any decision affecting safety, health, or property.

Schedules, game times, and venue information are likewise provided "as is" and may change; we do not guarantee their accuracy or completeness.

3. Subscriptions and billing

Weatherball may offer optional auto-renewing subscriptions that unlock additional features. The following terms apply:

Payment is charged to your Apple ID account at confirmation of purchase.
Subscriptions automatically renew for the same period at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period.
Your account is charged for renewal within 24 hours prior to the end of the current period.
You can manage or cancel your subscription, and turn off auto-renewal, in iOS Settings → [your name] → Subscriptions after purchase.
Any unused portion of a free trial, if offered, is forfeited when you purchase a subscription.
Prices and plan details are shown in the app at the point of purchase.

Purchases and refunds are handled by Apple. Refund requests can be made at reportaproblem.apple.com.

4. Acceptable use

You agree not to misuse Weatherball or its backend services, including by attempting to disrupt them, access them through unauthorized means, scrape or bulk-extract data, or use the app in violation of any applicable law.

5. Intellectual property

Weatherball, including its software, design, and content we provide, is owned by 44 Points and protected by intellectual-property laws. Team names, logos, and league marks are the property of their respective owners; their appearance in the app does not imply endorsement.

6. Disclaimer of warranties

Weatherball is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that data will be accurate.

7. Limitation of liability

To the maximum extent permitted by law, 44 Points will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising out of your use of, or inability to use, Weatherball — including any reliance on weather or schedule information.

8. Apple as a third-party beneficiary

These Terms are between you and 44 Points only, not with Apple. Apple is not responsible for Weatherball or its content. To the extent these Terms provide for app maintenance, support, warranties, product claims, or legal compliance, those obligations are ours and not Apple's. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. The Apple Standard EULA also applies; where it conflicts with these Terms, the terms more protective of you for consumer-rights purposes control.

9. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Your continued use of Weatherball after changes take effect constitutes acceptance.
